The terms that govern your use of PatchMortem and the services provided by Zurlux Technologies Private Limited.
These Terms govern access to and use of PatchMortem. By using the Service you agree to them.

Subject to these Terms and payment of applicable fees, Zurlux grants you a non-exclusive, non-transferable right to access and use the Service during the subscription term, for the number of Endpoints stated in your order form.
All plans include a 30-day free trial. No credit card is required for the trial, and no commitment arises until a subscription is agreed.
You may not use the Service to attack, disrupt, or gain unauthorised access to any system; to circumvent the approval controls or audit chain integrity of the Service; to reverse engineer the classifier or errata corpus; or to resell the Service without a written partner agreement.
You retain all rights in Customer Data. Zurlux acts as Data Processor and you as Data Fiduciary under the Digital Personal Data Protection Act 2023, governed by a signed Data Processing Addendum.
All Customer Data is stored and processed in AWS ap-south-1 (Mumbai). Audit Chain records are append-only and cannot be edited or deleted by any user, including Zurlux staff.
The Service classifies patch failures and, where you have enabled remediation and the applicable policy permits it, executes a rollback. Remediation is disabled by default and must be enabled explicitly, per policy, per host group.
The Service will decline to remediate where it determines a rollback is unsafe — including driver installations, firmware flashes, and schema changes — and will flag those for human decision instead. You remain responsible for the operation of your infrastructure and for the approval policies you configure.
We aim to provide the Service continuously, subject to planned maintenance notified in advance and to events outside our reasonable control. SLA-backed uptime commitments are available on the Elite plan and are set out in the applicable order form.
Fees are stated in Indian Rupees and billed annually in advance unless otherwise agreed. GST applies at prevailing rates. Where the subscription is transacted through AWS Marketplace, AWS billing terms apply in addition to these Terms.
Upgrades within a term are prorated. Downgrades take effect at renewal.
Zurlux retains all rights in the Service, including the classifier, the errata corpus, the rollback method library, and all associated software and documentation. Nothing in these Terms transfers ownership of any of it to you.
Each party will protect the other's confidential information with at least the care it applies to its own, and will use it only for the purpose of the engagement. This obligation survives termination.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential loss, or for loss of profit, revenue, or data, arising out of or in connection with the Service.
Each party's aggregate liability arising out of or in connection with these Terms is limited to the fees paid or payable by you in the twelve months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
You will indemnify Zurlux against claims arising from your use of the Service in breach of these Terms or in breach of applicable law. Zurlux will indemnify you against third-party claims that the Service, used as permitted, infringes that third party's intellectual property rights in India.
The subscription runs for the term stated in your order form and renews unless either party gives notice before renewal. Either party may terminate for material breach that remains uncured 30 days after written notice.
On termination, you may export your Audit Chain and Customer Data. After a wind-down period agreed in the DPA, we will delete Customer Data from production systems.
We may update these Terms. Where a change is material, we will notify you in writing before it takes effect. Continued use of the Service after that date constitutes acceptance.
These Terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction, save that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
